Order Terms & Conditions

"Seller" means Tentnology® Co. "Buyer" means Purchaser as indicated within the Billing Address on the Sales Order.

Terms

Standard product – As indicated within the Sales Order; Buyer agrees to pay Seller 1.5% per month compound interest on any unpaid balance over 30 days. Customized product – Pre-paid in full to confirm order; non-refundable.

Check your Shipment

For Buyer's protection, Buyer is to check all cartons against Bill-of-Landing before signing for shipment. If there is any shortage or damage, Buyer is required to have the carrier's driver make a notation on shipping receipt. Buyer must then initiate claim for loss or damage with carrier without delay. Buyer must ensure carrier inspects goods and advises of any specific claim procedures which the buyer must adhere to. Tentnology® will assist with claims as necessary, but Buyer agrees to provide Bill-of-Landing with notation of loss or damage clearly marked by the carrier.

Transport

Tentnology® is not responsible for merchandise damaged in transit. Tentnology's liability ceases when Buyer receives Bill-of-Lading from carrier and has signed in receipt of the merchandise in good order. When the seller ships an order freight collect, the Buyer is solely responsible for freight damage and payment of freight costs and shortages to the delivering carrier.

Cancellations

Buyer shall not cancel orders once Tentnology® has received signed order and commenced production. Tentnology® reserves the right to add proportionate charges to Buyer's change-orders and approved variations.

Returns

Buyer shall not return goods without prior written approval/ RMA number from Tentnology®. Seller will not accept unauthorized returns. In the event Buyer requests permission to return goods, Buyer must supply invoice date and number along with reason for return. Buyer must ensure letter of explanation accompanies all authorized returns. Authorization does not imply credit. Seller shall inspect goods promptly & determine responsibility. Buyer must return problem item within 60 days of original ship date. In the event Seller determines the items returned are not Seller's responsibility, Buyer agrees to pay Seller the assessed minimum 25% restocking charge.

Liability Statement

Buyer hereby acknowledges that Buyer is a sophisticated purchaser. Buyer shall exonerate, discharge, and agree to protect and save harmless and indemnify Seller from any and all liability for claims for loss, damage, injury or other casualty to persons or property caused or occasioned by Buyer negligence in or by reason of the installation, use, operation and / or repair and modification of the said equipment, including failure to read instructions or warning labels. In the event Buyer specifies fabric or other elements non-standard to Tentnology®, Tentnology® shall be deemed acting as contractor only for customer designed product & Buyer hereby waives any claim against Tentnology® for failure due to said material, its application or performance.

Weather

Since weather is unpredictable, Buyer must incorporate his own good judgment, common sense, & knowledge of local conditions with the installation instructions guidelines. Buyer is responsible to anticipate weather severity for proper time and method of construction, appropriateness of product for the intended site as well as evacuation or disassembly details. A successful event is a safe event, for assembly to take-down.

Installation Instructions

Buyer must evaluate each installation site and determine securing & anchoring method & devices appropriate for the conditions. Some soils require different staking or securing than may be provided with tent. Seller highly recommends Buyer engages in thorough training of his Tent Operators. Seller's user manual can impact all the functions of a product, the rules for using them and suggestions for their use. Seller's video instructions illustrate excellent graphic examples of operating techniques. Following the instructions given under the condition specified or illustrated will provide proven satisfactory results. However, field situations, site conditions, weather & local experience may mandate other methods.

In addition, instructional aids are not a replacement for the interactive process of hands-on training provided by Tentnology® experts. Along with techniques of product use, the trainer may provide valuable information & suggestions on using the product under Buyer's unique conditions. Buyer shall contact Tentnology® to arrange for instructor.

Equipment

Shall include the normal anchoring devices and hardware required for set-up and use as ordered herein. Any additional equipment or materials required (e.g. special anchorage) shall be at the expense of the Buyer.

Permits & Licenses

Buyer shall be responsible for obtaining any and all permits required for the rental or use of the above mentioned equipment.
